GENERAL BILL by Criminal Justice Subcommittee, Tendrich, Nix; (CO-INTRODUCERS) Alvarez, J., Aristide, Bankson, Barnaby, Bartleman, Basabe, Black, Campbell, Chambliss, Daniels, Driskell, Dunkley, Franklin, Gerwig, Grow, Hart-Lowman, Jacques, Johnson, López, J., Michael, Owen, Redondo, Rosenwald, Spencer, Steele, Valdés, Weinberger, Yarkosky
Domestic Violence and Protective Injunctions; Provides enhanced penalties for committing domestic violence offense if person has prior conviction for domestic violence; provides that sentencing & incentive gain-time eligibility determinations are made without regard to penalty enhancement; authorizes & in certain circumstances requires court to order electronic monitoring in domestic violence cases; requires respondent to pay for such electronic monitoring services; revises information contained in petition for injunction for protection against domestic violence; revises factors judge may consider in determining whether to grant petition for injunction against domestic violence; requires FDLE to enter injunctions against dating violence & sexual violence into statewide verification system; requires law enforcement officer to make specified notification if he or she has probable cause to believe that person violated military protective order; authorizes & in certain circumstances requires court to order electronic monitoring for respondent in injunction for protection against dating violence, repeat violence, or sexual violence; requires respondent to pay for such electronic monitoring services; increases dollar amounts for relocation assistance for victims of domestic violence.
